These Terms of Service apply to your use of smartswimsuits.com.au and any purchase you make from Smart Swimsuits (ABN 11 078 133 614) ("we", "us", "our"). By using our website or placing an order, you agree to these terms.

1. Your consumer rights

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law, New Zealand's Consumer Guarantees Act 1993 or Fair Trading Act 1986, or any other law that can't be excluded.

2. Who can order

We sell to customers with a delivery address in Australia or New Zealand. You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.

3. Products and descriptions

We try to describe and photograph our products accurately. Colours and prints may look slightly different depending on your screen. Product availability may change without notice.

4. Sun safety

Smart Swimsuits are tan-through swimwear. The fabric is designed to let sunlight reach your skin, and it is not sun-protective clothing. Our swimwear should not be relied on for protection from UV radiation. Please follow sun-safe practices: check the UV index, use sunscreen, and limit your time in the sun.

5. Prices

Prices are shown in Australian dollars (AUD) or New Zealand dollars (NZD), depending on your location. Australian prices include GST. Shipping is free to Australia and New Zealand.

If a product is listed at an incorrect price because of an obvious error, we may cancel the order and give you a full refund, even after it has been confirmed.

6. Orders

Your order is an offer to buy. We accept it when we dispatch your items. We may decline or cancel an order, for example if an item is out of stock, there is a pricing error, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.

7. Payment

We accept Visa, Mastercard, American Express, Afterpay, Shop Pay, Apple Pay and Google Pay. Payment is taken when you place your order. Afterpay purchases are also subject to Afterpay's own terms.

8. Discount codes and gift cards

Discount codes can't be combined unless stated, have no cash value, and may be withdrawn at any time. Our newsletter code gives 10% off full-price items on your first order only.
Gift cards don't expire, can't be exchanged for cash, and can't be used to buy other gift cards. Please keep your gift card code safe; we can't replace a lost or stolen code that has already been used.

9. Shipping and returns

Shipping is covered by our Shipping Policy. Returns and refunds are covered by our Return & Refund Policy. Both form part of these terms.

10. Your account

You're responsible for keeping your login details secure and for activity on your account. Please contact us straight away if you think someone else has accessed it.

11. Intellectual property

All content on this website, including our prints, designs, photographs, text, logos and the Smart Swimsuits name, belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.

12. Using our website

You agree not to misuse our website, including by attempting to gain unauthorised access, interfering with its operation, or using it for any unlawful purpose.

13. Limitation of liability

To the extent permitted by law, and subject to your rights under section 1, we are not liable for any indirect or consequential loss arising from your use of our website or products. Where our liability can be limited, it is limited to replacing the goods, or refunding the price you paid for them.

14. Privacy

We handle your personal information in line with our Privacy Policy.

15. Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the jurisdiction of the courts of Victoria. This doesn't remove any rights New Zealand customers have under New Zealand consumer law.
